Welcome to Grit Kore (“Grit Kore,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of gritkore.com, our online store, content, programs, and services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy and Return Policy. If you do not agree, do not use the Services.

1) Eligibility & Account

  • You must be at least 13 years old to use the Services and at least 18 to make purchases.
  • You’re responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of unauthorized use: events@gritkore.com.

2) Purchases, Pricing & Billing

  • We may change prices, descriptions, or availability without notice.
  • Taxes and shipping are added at checkout where applicable.
  • By submitting a payment method, you authorize us (or our payment processor) to charge your method for the total order amount.
  • Promotions, coupon codes, and special offers are subject to separate terms and may be modified or discontinued at any time.

3) Shipping, Returns & Exchanges

  • Shipping times are estimates and not guarantees. Risk of loss passes to you upon our delivery to the carrier.
  • Returns, exchanges, and refunds are handled under our Return Policy.
  • Certain items may be final sale and not eligible for return.

4) Digital Content & Programs

  • Some purchases include access to digital content, courses, memberships, or downloads (“Digital Content”).
  • Unless expressly stated otherwise, all Digital Content is licensed, not sold, for your personal, non‑commercial use.
  • Do not copy, share, resell, record, or redistribute Digital Content without our written permission.

5) Intellectual Property

  • The Services and all content, logos, graphics, product names, characters, and designs—including Grit Kore marks and original artwork—are owned by Grit Kore or our licensors and are protected by IP laws.
  • We grant you a limited, revocable, non‑transferable license to access and use the Services for personal, non‑commercial purposes.
  • You may not use our trademarks without prior written consent.

6) User Content & Feedback

  • If you post, upload, or otherwise make available content (“User Content”), you grant Grit Kore a worldwide, royalty‑free, sublicensable license to use, reproduce, modify, adapt, publish, and display such content in connection with operating and improving the Services and marketing Grit Kore (in any media).
  • You represent that your User Content does not infringe any third‑party rights, is lawful, and complies with these Terms.
  • Feedback or ideas you submit may be used without restriction or obligation to you.

7) Acceptable Use

You agree not to: – Violate any law, contract, or third‑party right. – Harvest data, scrape, crawl, or use bots without permission. – Upload malware or interfere with the operation or security of the Services. – Impersonate any person or entity, or misrepresent your affiliation. – Use the Services to harass, abuse, or harm others, or post obscene, hateful, or infringing content. – Reverse engineer, decompile, or attempt to access source code, except where permitted by law.

We may suspend or terminate access for violations (see Section 13).

8) Third‑Party Services & Links

The Services may link to third‑party sites or use third‑party tools (e.g., payment processors, shipping carriers). We are not responsible for third‑party content, policies, or practices. Use them at your own risk.

9) DMCA / Copyright Complaints

If you believe content on the Services infringes your copyright, please send a notice to events@gritkore.com with: 1. Your contact information; 2. A description and location (URL) of the allegedly infringing material; 3. A statement that you have a good‑faith belief the use is not authorized; 4. A statement, under penalty of perjury, that the information is accurate and you’re authorized to act; 5. Your physical or electronic signature.

We may remove content and terminate repeat infringers in appropriate circumstances.

10) Privacy & Cookies

Your use of the Services is subject to our Privacy Policy. We and our partners may use cookies and similar technologies to operate the Services and for analytics/marketing. Manage preferences in your browser or device settings.

11) Disclaimer of Warranties

To the fullest extent permitted by law, the Services, products, and Digital Content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that the Services will be uninterrupted, secure, or error‑free.

12) Limitation of Liability

To the fullest extent permitted by law, Grit Kore and our affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Services. Our aggregate liability for any claim will not exceed the greater of (a) USD $100 or (b) the amount you paid to Grit Kore for the product or Service giving rise to the claim in the 12 months preceding the claim.

Some jurisdictions do not allow certain limitations; in those cases, the above limits apply to the maximum extent allowed.

13) Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you violated these Terms or for any reason. You may stop using the Services at any time. Sections that by their nature should survive (e.g., IP, disclaimers, limitations, indemnity) will survive termination.

14) Indemnification

You agree to defend, indemnify, and hold harmless Grit Kore and our affiliates, officers, employees, and agents from and against any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms.

15) Governing Law; Venue

These Terms are governed by the laws of the State of Connecticut, without regard to conflict‑of‑law rules. You agree that the state and federal courts located in Fairfield County, Connecticut will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to personal jurisdiction and venue in those courts. Small‑claims court remains available where permitted.

Optional arbitration language can be added here upon request.

16) Changes to the Services or Terms

We may update these Terms from time to time. If we make material changes, we’ll post the updated Terms with a new “Last updated” date. Your continued use after changes means you accept the revised Terms.

17) International Use

You are responsible for complying with local laws. Products may not be available or appropriate in all jurisdictions. You may not use the Services if prohibited by applicable law, including export control laws.
